Question: What kinds of things are copyrightable?
Answer: In order for material to be copyrightable, it must be original and must be in a fixed medium.
The requirement that works be in a fixed medium leaves out certain forms of expression, most notably choreography and oral performances such as speeches. For instance, if I perform a Klingon death wail in a local park, my performance is not copyrightable. However, if I film the performance, then the film is copyrightable.
у меня вопрос, однако. если у меня веб-страница динамическая, то ни на каком вещественном носителе она не существует - она генерится неким кодом в ответ на запрос. то есть, ещё даже менее вещественная, чем Klingon death wail in a local park. получается, что динамические web-страницы - не copyrightable?

Date: 2005-06-24 07:01 pm (UTC)the copyright law specifically requires "fixed medium", which leaves out acoustic waves and, obviously, state of bits in the computer memory during one particular microsecond. it is interesting though where this "fixed medium" requirement came from... I have to dig more on this.

Which means exactly this: the film is copyrightable, not the performance itself. So if somebody else also films the performance, I can't do a shit about it; he can even redistribute the film if he wants to. the same thing in your example with tape: only tape itself is copyrightable.
anyway, it's all not very relevant; my point is that internet is a very powerful beast with it's own nature, it need's it's own laws. actually, it is not my point, it's Cory Doctorow's point.
