Answer: In order for material to be copyrightable, it must be original and must be in a fixed medium.

The requirement that works be in a fixed medium leaves out certain forms of expression, most notably choreography and oral performances such as speeches. For instance, if I perform a Klingon death wail in a local park, my performance is not copyrightable. However, if I film the performance, then the film is copyrightable.

у меня вопрос, однако. если у меня веб-страница динамическая, то ни на каком вещественном носителе она не существует - она генерится неким кодом в ответ на запрос. то есть, ещё даже менее вещественная, чем Klingon death wail in a local park. получается, что динамические web-страницы - не copyrightable?

dynamic web pages... if they are not copyrightable how about the content itself? I think so... this is what I seem to have seen...

you see, speeches are not copyrightable, even though some of them may carry content :-)

the copyright law specifically requires "fixed medium", which leaves out acoustic waves and, obviously, state of bits in the computer memory during one particular microsecond. it is interesting though where this "fixed medium" requirement came from... I have to dig more on this.

the person performing the speech might be reading copywritten material and as such the words but not the performance could be copyright protected... and if the performance were recorded, then it too (taped material) could be copyright protected. In my opinion. I don't know what the law would state on such.

Russian? no, I can't read Russian. I have a difficult enough time with English (as translated by 'babelfish').

that's exactly what example says: However, if I film the performance, then the film is copyrightable. Which means exactly this: the film is copyrightable, not the performance itself. So if somebody else also films the performance, I can't do a shit about it; he can even redistribute the film if he wants to. the same thing in your example with tape: only tape itself is copyrightable.

anyway, it's all not very relevant; my point is that internet is a very powerful beast with it's own nature, it need's it's own laws. actually, it is not my point, it's Cory Doctorow's point.

разумеется, в базе лежит не страница. вы прямо вот так страницы в базу кладёте? или в скрипты зашиваете?

была помнится такая программа - стихоплюй.
в теории в базе могут быть только слова. общеупотребительные. неужели есть копирайт на отдельные слова? (ну исключая наверное новояз).
тогда заверните мне "х-й", "б-дь", и две "е-твоих-матери" :)

не, результат - это динамическая, а не статическая станица, и ни на каком fixed medium она не существует.
